1. Agreement to Terms

By accessing and using the Butterfly Studios Pilates website at butterflystudiospilates.com (the "Site") or participating in classes and services at Butterfly Studios Pilates ("Studio," "we," "us"), you accept and agree to be bound by these Terms of Service and our Privacy Policy. If you do not agree to these terms, please do not use the Site or our services.

2. Use of the Site

You agree to use this Site only for lawful purposes and in a manner that does not infringe the rights of others or restrict or inhibit anyone else's use and enjoyment of the Site. Prohibited behavior includes, but is not limited to:

• Conducting any unlawful or fraudulent activity
• Transmitting any unsolicited or unauthorized advertising or promotional material
• Knowingly transmitting any data that contains viruses, trojan horses, worms, or any other harmful programs
• Attempting to gain unauthorized access to the Site, the server on which the Site is stored, or any connected server or database

3. Intellectual Property

The content on this Site, including but not limited to text, graphics, logos, images, and software, is the property of Butterfly Studios Pilates and is protected by applicable intellectual property laws. You may not reproduce, distribute, or create derivative works from any content on this Site without our express written permission.

4. Booking and Appointments

Booking and appointment management is handled through the WellnessLiving platform. By making a booking, you also agree to WellnessLiving's terms and conditions.

• Class spots are reserved on a first-come, first-served basis through our booking platform.
• Pre-registration is required for all group classes and private sessions.
• Walk-in availability is subject to class capacity.
• You must have a valid class credit, pack, or membership to reserve a spot.

5. Cancellation Policy

We understand life happens. Our cancellation policy:

• Group classes: Cancel at least 8 hours before class start time to avoid forfeiting your class credit.
• Private sessions: Cancel at least 24 hours in advance to avoid a late cancellation fee equal to the session cost.
• No-shows: Clients who do not show up will forfeit the session credit.
• Exceptions may be made for genuine medical emergencies at the Studio's discretion.

6. Class Packs & Memberships

• Class packs expire as indicated at the time of purchase. Expired credits are not refunded or extended.
• Memberships auto-renew on a monthly or agreed billing cycle unless cancelled in writing with 30 days notice.
• Class credits are non-transferable and cannot be shared between accounts.
• Refunds on class packs are not available after the first class has been used.

7. Health & Medical Disclaimer

The information provided on this Site is for general informational purposes only and is not intended as a substitute for professional medical advice, diagnosis, or treatment. By participating in Pilates and fitness activities at Butterfly Studios, you acknowledge:

• You are medically cleared to participate in physical exercise.
• You will inform your instructor of any injuries, medical conditions, or limitations before each session.
• Information provided by our instructors is for educational purposes only and is not medical advice.
• You agree to a liability waiver upon joining, as required by California law.

8. Studio Conduct

To ensure a safe and welcoming environment for all:

• Arrive at least 5 minutes before your class or appointment.
• Wear grip socks during all Reformer classes (available for purchase at the studio).
• Cell phones must be silenced during class.
• The Studio reserves the right to refuse service to anyone who behaves disrespectfully toward staff or members.

9. Payments

All purchases are processed securely through WellnessLiving. Prices are subject to change with notice. All sales are final except as expressly stated in our cancellation policy.

10. User Accounts

If you create an account through our booking platform, you are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to notify us immediately of any unauthorized use of your account.

11. Third-Party Links

This Site may contain links to third-party websites. These links are provided for your convenience only. Butterfly Studios Pilates has no control over the content of those sites and accepts no responsibility for them or for any loss or damage that may arise from your use of them.

12. Disclaimer of Warranties

This Site is provided on an "as is" and "as available" basis without any warranties of any kind, whether express or implied. Butterfly Studios Pilates does not warrant that the Site will be uninterrupted, error-free, or free of viruses or other harmful components.

13. Limitation of Liability

To the maximum extent permitted by California law, Butterfly Studios Pilates shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, arising from your use of the Site or services. Our total liability shall not exceed the amount paid by you in the 30 days preceding the claim.

14. Children's Privacy

This Site is not directed at children under the age of 13. We do not knowingly collect personal information from children under 13. If you are a parent or guardian and believe your child has provided us with personal information, please contact us so we can take appropriate action.

15. Changes to Terms

We reserve the right to update or modify these Terms of Service at any time without prior notice. Your continued use of the Site following any changes constitutes your acceptance of the new Terms.

16. Governing Law

These Terms of Service shall be governed by and construed in accordance with the laws of the State of California. Any disputes arising under or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts of California.
